 The article deals with one of the most frequently discussed issues in international investment arbitration. Author especially focuses on the state-owned enterprise. Mentioned in this article, the state-owned enterprises can get into legal disputes not only in the field of trade liberalization agreements (e.g. Bilateral investment Treaty (BIT), Free trade agreement (FTA), etc.), but also in other areas of the international economy. Particularly, the problem of legal position of state-owned enterprises being in the role of a foreign investor regarding the issue of international investment arbitration recognized in the international investment law is extremely important
